Frustration w/ Letter of Exemplification (NY)

Postby danar » Mon Mar 01, 2010 4:32 pm

Hi all:

I just called the Italian Consulate (NY) and asked if birth/marriage/death certificates require a Letter of Exemplification and they said no. They said they only require the translation and apostille. However, according to the Bureau of Vital Records, a Letter of Exemplification should be sent along with every certificate that is requested. Has anyone gone to the NY consulate with their documents WITHOUT having the LOE for each?

Thanks.

I did not bring nor did they ask for a letter of exemplification. Translation and apostile is what they told us we needed.

Note that a letter of exemplification may be required to get an Apostille. For example, to get an Apostille on a certificate issued by NYC, you must obtain a letter of exemplification together with the certificate, then get the two documents signed-off by the NY County Clerk, then send the whole mess to the State for an Apostille. On the other hand, certificates issued by NY State do not require this, as the State will issue an Apostille if you just send them the certificate.

See: http://apostille.us/faq/how_do_i_obtain_an_apostille_or_authentication_in_new_york.shtml

Thus, while the Consulate is telling you that they do not require a letter of exemplification, but do require an Apostille, you may nonetheless require a letter of exemplification in order to get an Apostille.

Uwlaw is exactly right. The consulate does not require a letter of exemplification. It does require and apostille, however, and the only way to get an apostille for NYC issued documents is with the exemplification letter. The document and the letter then goes to the county clerk for notarization. Only then will the document receive an apostille.
